We strive to make our commercial use licensing easy to understand. While most of our items are covered by our Standard Commercial License, we do have a few items which are covered by our Editorial Use License.
Editorial Use Licensing Terms
Editorial items (‘Editorial Items’) are items which may not have model or property releases or they may have trademarks, product designs, and other elements that are copyrighted by third-party organizations and individuals.
Editorial Items are intended to be used in only instances of creating content that falls under Section 107 of the Copyright Act for Fair Use, and are only to be used for editorial purposes, such as news reporting, discussion of events or educational purposes.
Stein Mixed Media does not grant any right or make any warranty with regard to the use of names, people, trademarks, trade dress, logos, registered, unregistered or copyrighted audio, designs, works of art or architecture depicted or contained in the content.
Some jurisdictions provide legal protection against a person’s image, likeness or property being used for commercial purposes when they have not provided a release. You are also solely responsible for obtaining necessary releases and the payment of any amounts that may be due under, and compliance with any other terms of, any agreements with third-parties as a result of your use of the Editorial Use licensed content. You are responsible for any consequences that may occur from not complying with applicable copyright laws in your jurisdiction.
You may not use Editorial Items commercially. If you wish to use an Editorial Item for commercial purposes, you are responsible for obtaining any necessary approvals from third parties before using the Editorial Item for a commercial purpose.
If you use Items marked as Editorial Use Licensing, you assume all risks and responsibilities for obtaining proper releases and permission to use the item in any way.
In these cases, you are fully responsible for determining whether releases may be required in connection with your proposed use of the content, and you are solely responsible for obtaining such releases. No releases are obtained for items identified as “editorial use”.
All Editorial Items are provided “as is” without warranty of any kind, either express or implied, including, but not limited to the implied warranties of non-infringement, merchantability, or fitness for a particular purpose. We are not responsible if your usage of an editorial use image may violate copyright or trademark laws or result in the consequences of violating copyright and trademark laws through litigation or DMCA takedown notices.
